BMC Black Card – Referral Program Terms & Conditions

Effective Date: 01.04.2026

1. Black Card Overview

The BMC Black Card is an exclusive membership card issued by Bavarian Motor Cars GmbH (“BMC”). It may be provided to customers upon delivery of their vehicle as well as to selected individuals at BMC’s discretion.

  • The Black Card represents trust, recognition, and premium status.
  • The Delivery Agent provides the Black Card directly to the customer at the time of vehicle delivery.
  • The Black Card is non-transferable and remains the property of BMC.
  • Holding a Black Card allows the customer to participate in the Referral Program.

2. Referral Program Overview

The Referral Program rewards Black Card holders for referring new customers who complete a vehicle purchase and delivery with BMC.

  • Each successful referral entitles the referrer to a predefined incentive set by BMC, which you can find on our Black Card landing page: https://bavarianmotorcars.com/black-card
  • Only Black Card holders are eligible to participate.
  • The incentive applicable at the time of successful referral confirmation shall apply.

3. Definition of a Successful Referral

A referral is considered successful only if all of the following criteria are met:

3.1 New Customer Acquisition: The referred customer must be a new customer to BMC, complete the purchase of a new vehicle (SPO or in-stock vehicle), and take delivery of that vehicle. Pre-owned vehicles are not eligible.

3.2 Active Identification: The referred customer must independently identify the referring Black Card holder to BMC by providing the referrer’s unique Black Card ID at the time of their initial inquiry.

3.3 Sales Confirmation: The referral must be verified and confirmed by the BMC Sales department. Only after these conditions are met will the predefined incentive be granted to the referring customer. Referrals that cannot be clearly attributed due to missing or late information from the referred customer, or where delivery does not occur, do not qualify for incentives.

4. Eligibility

  • Customers must hold a BMC Black Card to participate.
  • Incentives are issued once per successful referral.
  • There is no limit on the number of referrals a customer may make.

The Black Card represents recognition; incentives are separate and only provided according to these Terms & Conditions.

5. Incentive Terms

  • Incentives are predefined by BMC and non-transferable.
  • Incentives are redeemable only with Bavarian Motor Cars GmbH unless explicitly stated otherwise.
  • Incentives, including accessory and maintenance credit, may only be redeemed for products, parts, and services supplied and invoiced by Bavarian Motor Cars GmbH. Any use with or through third-party providers is strictly excluded unless explicitly stated otherwise.
  • Incentives are redeemable only as specified and cannot be exchanged for cash or other alternatives unless explicitly stated.
  • Incentives become valid only upon confirmation of a successful referral and delivery of the referred vehicle.
  • Incentives are granted exclusively for referrals resulting in the purchase and delivery of a new vehicle (SPO or in-stock vehicle). Pre-owned vehicles are excluded.

Where an incentive is defined by BMC as a cash reward, payment shall be made exclusively by bank transfer (wire transfer) to a bank account designated by the eligible participant. Any other form of payment, including cash payments, cheque payments, or payments via third-party payment services, is expressly excluded and shall not be offered.

The incentive applicable to a successful referral shall be the incentive defined and published by BMC at the time the referral is confirmed by BMC Sales.

Incentives displayed on the BMC Black Card landing page or other marketing materials are for informational purposes only and do not constitute a legally binding offer.

Only the incentive officially recorded and confirmed internally by BMC at the time of referral confirmation shall apply.

BMC reserves the right to modify or update incentives at any time with effect for future referrals.

BMC will notify the referring customer once a referral has been confirmed.

Incentives must be claimed by the referring customer within two (2) years from the date of vehicle delivery to the referred customer.

After this period, any claim to the incentive shall expire and can no longer be asserted.

6. Exclusions & Misuse

The following are not eligible for referral incentives:

  • Self-referrals
  • Duplicate referrals
  • Referrals without a completed sale or delivery
  • Any attempt to manipulate or misrepresent referral origin
  • Referrals resulting in the purchase of pre-owned or demonstrator vehicles

BMC reserves the right to:

  • Deny incentive issuance
  • Revoke incentives
  • Exclude participants from the program in cases of misuse

7. Card Terms

  • The BMC Black Card is non-transferable.
  • Card numbers are internal reference identifiers.
  • Loss or damage of a card does not affect referral eligibility.
  • Replacement cards are optional and at BMC’s discretion.

8. Exceptions

  • Any exceptions require approval from Program Administration and must be documented.
  • No automatic exceptions are allowed.

9. Governance & Amendments

These Terms & Conditions ensure consistency, fairness, and compliance.

9.1 BMC reserves the right to amend these Terms & Conditions for valid reasons, in particular due to legal, regulatory, or technical changes, or to improve the Referral Program.

9.2 Participants will be informed of any changes in text form (e.g., via email) at least four (4) weeks before the changes take effect.

9.3 For material changes that significantly alter the balance of rights and obligations between the participant and BMC to the detriment of the participant, BMC will request the participant's explicit active consent.

9.4 For minor changes (e.g., administrative updates, legal adjustments that do not negatively impact the participant), the changes shall be deemed accepted if the participant does not object in text form within four (4) weeks after receiving the notification. In the notification of change, BMC will explicitly inform the participant of this right to object, the deadline, and the consequence of remaining silent.

9.5 Continued participation in the program after actively consenting (for material changes) or after the objection period has expired without objection (for minor changes) constitutes acceptance of the updated Terms.

10. Liability

BMC shall be liable without limitation in cases of intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit).

In cases of slight negligence (leichte Fahrlässigkeit), BMC shall only be liable for the breach of essential contractual obligations (Kardinalpflichten). In such cases, liability shall be limited to the foreseeable, typical damage.

BMC shall not be liable for indirect damages, consequential damages, or loss of profit.

The above limitations of liability shall not apply in cases of injury to life, body, or health, or where mandatory statutory liability applies.

11. Data Protection

11.1 BMC processes personal data in accordance with the General Data Protection Regulation (GDPR).

11.2 To protect the privacy of all parties, the referral process is designed as a "Customer-to-Customer" recommendation. The referring Black Card holder shall not provide personal contact data of the referred person directly to BMC.

11.3 Instead, the referred person must contact BMC independently and provide the necessary referral information in form of the unique referral ID at the beginning of their own inquiry or purchase process.

11.4 Personal data of both the referrer and the referred person will only be processed to the extent necessary to verify the eligibility and fulfill the incentive.

12. Applicable Law and Jurisdiction

These Terms & Conditions shall be governed by the laws of the Federal Republic of Germany.

The place of jurisdiction, to the extent permitted by law, shall be the registered office of BMC.

13. Taxes

Participants are solely responsible for any tax obligations arising from incentives received through the Referral Program.

14. Participation and Acceptance

These Terms & Conditions apply to all participants of the BMC Black Card Referral Program.

They are provided to the participant prior to participation and are accepted upon participation in the program.


Participation in the Referral Program does not establish any partnership, agency, or employment relationship between BMC and the participant.

Participation in the Referral Program does not create any legal entitlement to receive incentives beyond what is explicitly stated in these Terms & Conditions.

BMC reserves the right to terminate the Referral Program at any time with future effect.

In such case, referrals already completed and confirmed prior to termination will remain eligible for incentives.

BMC reserves the right to refuse or terminate participation of any participant at its reasonable discretion, to the extent permitted by law.
